Understanding No-Fault Insurance Vs. Comparative Negligence
New York has both no-fault insurance law and comparative negligence law. No-fault insurance means that insurance covers up to $50,000 of costs and expenses related to your injuries and the income lost because of injuries. It does not cover the cost of repairing your vehicle or compensate for any of your pain and suffering. If you have more than $50,000 in bills and decide to file a claim, comparative negligence comes into play.
Comparative negligence requires the court to determine how liable each party was in causing the accident. If you are awarded a settlement, the percentage of your liability is deducted from the settlement check. For example, if you are found to be 20% liable in the accident and the settlement was for $100,000, $20,000 would be deducted from the settlement and you would be awarded $80,000.
